Facebook: Wij bezitten uw data voor eeuwig en altijd

Facebook heeft een aantal kleine aanpassingen in zijn gebruiksvoorwaarden doorgevoerd. De sociale netwerkdienst claimt nu het totale eigendom over alle content die door gebruikers op de site wordt gezet.Tevens eigent Facebook zich het recht toe om alle content te mogen gebruiken voor diverse doeleinden, waaronder commerciële activiteiten. Zelfs wanneer u uw account stopzet, blijft Facebook eigenaar van uw data en informatie, waaronder uw foto's, video's en zelfs uw eigen naam.

Zo staat er in de nieuwe TOS (Terms Of Service) te lezen:
"You are solely responsible for the User Content that you Post on or through the Facebook Service.... You represent and warrant that you have all rights and permissions to grant the foregoing licenses."

Dit betekent dat wanneer u inbreuk doet op het auteursrecht van iemand anders door content naar uw Facebook-pagina te uploaden, dan is het allemaal uw eigen schuld en niet de schuld van Facebook. De content die u hebt geupload wordt vervolgens wel eigendom van Facebook.

"You hereby grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the Facebook Service or the promotion thereof subject only to your privacy settings or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof."

Hierboven staat dat alle content die u naar Facebook upload voor altijd eigendom wordt van Facebook, zelfs wanneer u uw account stopzet. Nadat u weg bent als lid mag Facebook uw naam, foto's en andere persoonlijke data blijven gebruiken voor allerlei doeleinden, zoals in advertenties.

"The 'Facebook Service' means the features, services and properties that Facebook makes available through (a) www.facebook.com or any other Facebook-branded or co-branded website (including, without limitation, any and all sub-domains and all international, mobile versions and successors thereof), (b) the Facebook Platform and ( c ) other media, devices or networks now existing or later developed."

In andere woorden; alles wat u op Facebook zet of een dochtersite, wordt automatisch eigendom van Facebook.

Alles wat u op Facebook hebt geplaatst, is vanaf deze week eigendom van Facebook. De kans is klein dat Facebook zijn nieuw verworven macht zal misbruiken door uw naam, foto's en videofilmpjes te verkopen aan de hoogste bieder. Maar het is zorgwekkend dat de netwerkdienst met het aanpassen van enkele zinnetjes zich grote hoeveelheden content in één keer toe-eigent.
